Los Angeles, CA — In an ironic twist of fate, Fox Broadcasting Company has decided to sue the President & CEO of Fox News. In their email sent today they told the President and CEO of Fox News, that its trademarked name of ‘FOX’ owns all the names associated with ‘FOX’. They demanded that Fox News cease and desist from any further use of the use of the word Fox News immediately. Fox also demanded any money that Fox News has made in ad revenue, among other things. So, I guess my first question in all of this is; when did ‘Fox’ start doing ‘news’?

To Whom It May Concern:
I am writing to you on behalf of Twentieth Century Fox Film Corporation and its related entities, including Fox News Network (collectively “Fox”). Fox is the exclusive owner of, inter alia, U.S. Trademark Reg. Nos. 1840919, 1924143 and 2318595 (for goods and services including “providing on-line services”) for FOX, 3619864 (for goods and services including “business and finance information transmitted via wireless communication devices”), 3627558 (for goods and services including internet streaming), and Reg. No. 2469849 for FOXNEWS.COM; and CTM Reg. No. 143065 for FOX NEWS (all collectively the “FOX Mark”). By virtue of their longstanding use in the United States and elsewhere, the FOX Mark has long since become famous. Fox owns and operates the http://www.foxnews.com/ website (the “FOX Site”).
It has come to our attention that you own and operate the http://foxnews.com.de/ website (the “Infringing Website”), which use the FOX Mark on a site featuring news stories (the “Infringing Use”)
Your use of the FOX Mark on the Infringing Website and in the Infringing Use creates consumer confusion because users encountering the FOX Mark and/or those familiar with the FOX Site will assume that Fox sponsors, endorses, or authorizes the use of the FOX Mark and/or the contents of your site, when it in fact does not. Accordingly, the Infringing Website and Infringing Use violate Fox’s trademark rights and constitute unfair competition under the Lanham Act. See 15 U.S.C. § 1114 and § 1025.
We therefore demand that you immediately:
- Cease all use, display or distribution of the FOX Mark in any manner whatsoever, including but not limited to; in the Infringing Website; in the Infringing Use; on all websites that you own, control or post on; in domain names; on Facebook, Twitter and all other social media sites; in emails; and in advertisements in any media;
- At your own expense, assign the http://foxnews.com.de/ URL to Fox;
- Identify the total revenue that the Infringing Website and Infringing Use have generated to date, and,
- Confirm in writing to the undersigned no later than August 7, 2015, that you shall fully and promptly comply with each of the foregoing demands.
Should you fail to comply with the above demands by the close of business on August 7, 2015, we will consider taking all appropriate action against you without further notice to you.
This letter is without prejudice to Fox’s rights and remedies, all of which are expressly reserved.
